There’s something about President Noynoy Aquino in Gladwell’s three books about his character that points to his potential to be Asia’s greatest statesman, probably greater than Singapore’s Lee Kuan Yew. What we see now in P Noy’s thoughts and actions is an utter LACK of MACHIAVELLIANISM which clinical psychologists had parallel studies as psychopathy.
Why P Noy cannot be like our past corrupt Presidents, Senators, Congressmen, Justices and high bureaucrats may be, but very likely will be explained by Dr. B. Oakley PhD. It is not possible to find President Noynoy in Dr. Oakley’s book which is about his opposites. The book is preponderantly about the enemies of the people as a whole or as individual citizens.
It is a face off between two scientific writers: Gladwell chronicles reasons behind successful good men while Oakley uses her scalpel to dissect the innards (este the genes) of successful evil men. Men and women that had or nowadays are still applying their craft to society. IF INTERESTED, just Google the authors’ names and the book titles will appear.

Sa isa sa nauna kong comment, I made a suggestion if you can come up with infographics for the appreciation of the youth who have short attention spans. (There was also a suggestion from among the CPMers to post or utilize the net cafes near or around the schools.)

Presenting blogs in the form 180.5.3, say is good because it sorts by date of the primary blogs (180 is the 180th oldest primary blog), then by date of the secondary blogs (180.5 is the 5th oldest reply to the 180th oldest primary blog), then by date of the tertiary blogs (180.5.3 is the3rd oldest reply to the 5th oldest secondary blog), etc.
But the format presents a problem for readers, like me, who want to read the most recent blogs to your articles. For example, important comments are still being posted on the Roseville property. I do not see a convenient way of reading the latest comments without scrolling past old comments.
I suggest that you put an option of sorting according to date only, and links on the body of the blog to its relevant blogs (e.g., links on blog 180.5.3 to 180.5, 180.5.2, and 180.5.4 if it exists).
This Pinoy hacktivists’ retaliation is an example of what we can do outside of diplomacy and these young techies are showing their potentials and for me an act of nationalism. I hope this kind of move in the cyberspace would also snowball, just like what you and the CPMers did on the Corona issue.

I’ll just want to share my observation regarding the issues on when to reflect a real property on the SALN and if possible this observations should be brought to the attention of the Prosecution Team for their rebuttal time. As noted in the current proceedings, the Defense Team of Corona reason out that the Column Property of 3.5 M was only reflected in the 2010 SALN since the actual delivery took place only in August of 2009, though the full payment was made in 2004 with the issuance of the Deed of Absolute Sale and the Certificate of Title.
Per generally accepted accounting principles or the latest international accounting standards, this should have been reflected in the 2003 and 2004 SALN of Corona since he already have a cash out of an ASSET called CASH during these years. However, the Defense Team insisted that this should only be recognized once there was an actual delivery to the buyer. This seems to me as only PALUSOT by the Defense.
Please try to REVIEW the SALN of Corona from 2002 to 2005, in 2002 there was no entry on his assets of a CONDO unit purchased in installments in 1997, however at the starts of 2003 this was already reflected on his SALN….please take a look on the footnote that says “TITLE TRANSFERRED ONLY UPON FULL PAYMENT IN 2003″. This footnote was repeatedly reflected in the SALN from 2004 and 2005. Meaning, Corona knows from the starts that the basis for the recognition of the ownership of a property is once you have fully paid the said property since this is the time that Deed of Absolute SAle will be executed, then the issuance Certificate of Title will follow.
Please review also the entries of the figure for ASSESED and FAIR MARKET VALUES for the other Properties from 2003 up to 2010, they were all they same…please take note that the Defense insisted that Corona’s basis for the figure were taken from the ASSESORS records or TAX Declarations. As presented in the Court by various witnesses yong mga ASSESORS, they said this values will change every 3 years as passed by their respective city councils thru an ordinance…
In 2002 SALN, there was an entry for MOTOR VEHICLES with an acquisition cost of P1.13M, however, this entry DISAPPEARED on his SALN in 2002-2010. Wala na ba syang motor vehicles during that period?
based on my observations, there was really an INTENT by Mr. Corona to hide his TRUE WEALTH by undervaluing his various properties.
Based on the interviews, it seemed to me – and many others in cyberspace – that his revelations/responses to questions posed to him elicited even more queries, instead of making things clearer.
(1) Corona admitted that he lost his “trust” in PS Bank, which supposedly accounts for him withdrawing his peso accounts on Dec. 12, 2011, the day the impeachment complaint became official.
Is his trust peso-denominated? The reason I ask this is because he did not withdraw his dollar account/s. Is there a special reason why one can claim distrust on the local currency accounts but still have faith in the dollar ones?
Also – correct me if I’m wrong – but didn’t the PS Bank President or Branch Manager testify during the trial that Corona re-deposited the money (pesos) into a single account, at the very same branch?
How does Corona define trust in a bank?

(2) Corona claims he is “not involved” in the family squabbles of his wife regarding their BGEI Corporation concerns.
Why did he then say that he took a loan from the company?
Why did he admit that the millions that were in his personal account/s were BGEI money?
Why did he say these were his wife’s and not his?
Why did he not declare these in his SALN, either from his personal account or as his wife’s money, with both cases covered under law as a must to declare?

(3) He claimed in one interview that he is all that stands between the President and what the President supposedly wants. (“Ako lang ang pumipigil na makuha ni Pnoy ang gusto nya.”)
Yet when their TRO decision on allowing former President Arroyo to travel was questioned, he said that the Supreme Court is a collegial body and that he is just one vote.
So, which is it? Are you the “last man standing” when it comes to the Palace, “valiantly” fighting off the dragons, or are you but one in a sea of voices?

(4) When asked if he himself would testify at the trial, he said he is willing but it is “dependent” on his lawyers.
Does he work for his lawyers? Why should he seek their clearance? Why would their permission be even needed? Here he is, on two TV stations proclaiming this and that, but you won’t face your charges in court?

We all know of Enrile’s modus operandi of “bantay-salakay”: faking an assassination attempt for proving terrorism; administering martial law as Marcos’ defense minister; promulgating laws as Batasang Pambansa assemblyman; funding RAM to launch a coup d’etat against Marcos ; joining People Power for fear of Marcos’ wrath; attempting a coup with right-hand-man Honasan against Cory while acting as her defense minister; voting against opening of the second bank envelope to keep Estrada; and now, pretending impartiality in the impeachment trial while impeding the truth about Corona from coming out.
There’s one aspect of Enrile’s skills that would be interesting to the public if you expose it: how did Enrile use his formidable knowledge in commercial law and taxation in order to set up and steal corporations for Marcos, hide ill-gotten income and wealth, foil lawsuits? Old SEC records may show how his expertise was used by Marcos to steal a reported $2 to $10 billion from the country.

Violence and Farce
What started out as a weekend show of Marcos “loyalists” turned into a weekly politically rally, then into violent Sunday demos, that eventually culminated in an open rebellion on July 6, exactly the 14th Sunday from Easter on the seventh month of the year. On that day, Tolentino took his oath as Vice-President of the Philippines and, in the absence of Marcos, proclaimed himself “acting President” under the l973 Constitution. The moment of Tolentino’s “last hurrah” had finally come, testing the four-month old Aquino revolutionary government.
In a ceremony at the driveway of the luxurious Manila Hotel, covered by both local and foreign media, the former running-mate of Dictator Marcos, flanked and backdropped by former members of the discredited defunct Batasan, was sworn into office by former Supreme Court Justice Serafin Cuevas. After naming his new “cabinet members”, the 75-year old “acting President” promptly directed former Speaker Nicanor Yñiguez to convene the Batasan, whose first order of business was to pass a law that would call for national elections at the earliest opportunity.
Members of the “Tolentino cabinet” included Rafael Recto as Justice Minister, Manuel Collantes as Foreign Affairs Minister, Isidro Rodriguez as Local Governments Minister and Manuel Alba as Budget Minister. Tolentino also appointed Juan Ponce Enrile Jr., Defense Minister, for whom the position of Prime Minister was reserved in concurrent capacity. Without the benefit of appointment, former assemblyman Gerardo Espina of Manila served as Acting Information Minister. Except for Enrile, who was “in the suburbs attending to private business”, all members of the “Tolentino cabinet” were present.
Before the oath -taking, Tolentino lowered the boom on President Aquino, describing her government as “illegal”. He claimed that Marcos and he were the country’s legitimate leaders, having been proclaimed “winners” in the last presidential and vice-presidential election by the Batasan, Characterizing both Cory Aquino and “Doy” Laurel as power grabbers, Tolentino produced a letter from Marcos authorizing him to assume as “legitimate head of the country until such time that I return to the Philippines.”
This is in reaction to the rantings and ravings of Miriam Santiago at the impeachment trial. When she took a private prosecutor to task and engaged him in what she termed a “colloquy,” little did anyone realize she meant to do a soliloquy and expected everyone to keep their mouth shut. For the irrepressible senator loves talking to and listening to herself so much she probably thinks she is the only person she can have a sane and intelligent conversation with. Thus, when the prosecutor tried to butt in, he should have seen it coming: “How dare you argue with me!”
After some hiatus due to high blood pressure (thank God for little mercies), Santiago returned with more barbs and rhubarbs. She was snorting like a raging bull—and did anyone notice those dagger-stares? She berated the prosecutors (again!) for not knowing the persnickety technicalities of the law. She also took potshots at her own colleagues for issuing subpoenas indiscriminately. We submit that having been away from the courtroom for a very long time, she already forgot the usual praxis that subpoenas are issued perfunctorily ex parte to compel production of testimonial and/or documentary evidence germane to the allegations made in a pleading (so long as they are not “privileged”). Nobody is sent to jail for procuring subpoenas in aid of prosecuting or defending cases. The paramount interest is the search for the truth. It is up to the court to determine the weight (or lack of it) of the evidence produced thereby.
But Santiago was simply being true to form: At times funny when in a good mood, but totally homicidal when provoked—which happens more often. Her colossal inability to manage her anger should be real cause for alarm. Lucky for us she won a seat as a judge in the International Criminal Court. Imagine what she would have said had she lost: “Who wants to be in the company of idiots anyway!” That’s what she said of our very own Supreme Court when the ship sailed without her in search of a new chief justice!
While in the Netherlands, she will be the egregious representation of the best “criminal” mind our country has to offer the world. Let’s all cross our fingers and earnestly pray she will not make a bizarre spectacle of herself there as she does so hilariously here almost all the time! Really, “[i]t’s more fun in the Philippines”?

Same complimentary perks are also given to VIP guests like high ranking government officials of a countries with casinos like what Mike Arroyo received from MGM or their high ranking casino executives like Genuino and Naguiat. This is standard operating procedure for all highend casinos.
I’m not a big whale but still my wife and I got complimentary gifts on arrival, perfume or jewelries in the form of coupons that could be redeemed from any high end stores in the casino grounds. Not unusual one whale coud get more than $ 2 M total comps in a year by going to the casino frequently. That is probably how Mrs. Naguiat got her Chanel bag, standard gift, and how Genuino and Naguiat got the perks unfortunately classified as bribe instead of casino business expense because they did not gamble. It’s not against US law because it is permitted business enticement to all gamblers and VIP guests.
The only motive Wynn against his partner is to derail Okada from owning his own casino in the Philippines in which their partnership is not involved and the best way to do it is destroy the credibilty of the 2 Pagcor officials which they accepted in good business faith, then the Philippine casino license would be jeopardized and Okada Nevada lcense would be revoked.
The only difference the Pagcor executives and Mike Arroyo were not whales. The reason Wynn classifed the perks as bribes rather than the standard “comps” since theydid not gamble commensurate to the comps given. In my assessment this is plain business squabble between partners. Wynn had a history of such greed when he owned his first casino, the Mirage,in which he also had some conflicts with his partners.
Same story, the rich partner bankrolled Wynn and when the business succeeded he started to squeeze out the partners.
What Genuino and Naguiat received were standard comps in casino for VIP guests.
This blog is dangerously uncritical and biased. Every article is a highway robbery and hit job on the defense side.
Specially the last blog on Cuevas issuing watch list orders. Thats not even the point. To attack him for doing his job provided in the constitution to provide equal protection is just, I dont know, you think of what word best describes that article.

Maybe you should practice investigative journalism in making your articles. You are overly simplistic, uncritical and biased in ALL of them which is a shame to investigative journalists everywhere.
2001 case is not homogenous to 2012. Being this biased is a disservice to the profession.
There were parallel occurences between the two events is all that was pointed out. Among other things, it serves to reiterate that the law should be CONSISTENTLY applied, not selectively interpreted to suit ones inividual motives. Currently, readers’ comments are buried by date. It would be better if they are ranked by importance by you, or by the number of likes or by the number of views, etc.
The Section may also be used by whistle blowers. For example, a PS Bank employee disgusted with Corona’s dollar accounts might do an expose (after a Watergate-like investigation by you, where you promise not to reveal “Deep Throat”). Or someone in the Supreme Court might have detailed knowledge on how corporate taipans get an audience with Justices.

I am not sure if you have read this yet or most probably you are already aware of this, but just the same, I want to share with you what I recently read from the abs-cbn website. These days, I have been keen on reading the news and your blog as well. Maybe this one could help, although we are not sure if the person posting the comment on the abs-cbn site is one with integrity, i guess there is nothing wrong if we try to dig further.

I agree that we should embrace the ideas put forth but we also need to get our arms around it so that there is some control and set boundaries at di pupunta kung saan-saan direction tayo.
I suggest another thread on whats and hows, e.g. what the objectives are? limit only on corruption? which branches of government to focus on. Baka naman others like PCIJ are working along similar lines. What do we need to be efficient and effective- feet on the street to do the walking for you and enhance blogsite for security and responsiveness? I don’t know but more heads may point us in the right direction. What sieve must be in place to ensure information getting in are not hoax or just to derail and waste time/effort running after the leads.
Maybe you can PM your reliables like Johnny Lin, Mel, et al. Or you can interview TAPATT if they have similar grassroots initatives web based.

I was wondering if you can ask some lawyer who can explain the intricacies of a subpoena.
As explained to me by a law student friend, a sheriff, during execution proceedings, can require a bank to divulge whether a person has an account with it although he has no previous knowledge of its existence. If a sheriff can do this, why can’t an impeachment court in a trial of this magnitude?
Can banks be summoned to divulge whether Corona accounts exist without banks giving details?
So the prosecution allegedly got a fake bank documents in the course of its own investigation; did it make the Corona accounts less real?
I hope, ma’am, that you can research on this and enlighten us.
my humble and unsolicited answer. this is because the prohibition against examination of the bank account does not preclude its being garnished for satisfaction of judgment. The disclosure will be purely incidental to the execution process and it was not the intention of the legislature to place bank deposits beyond the reach of judgment creditor. See PCIB v. CA, GR no. 84526, January 28, 1991 the sheriff will use a writ of garnishment issued by the court and not a mere subpoena.
Can the prosecution resort to discovery rules to compel banks to divulge whether or not Corona has bank accounts? A friend told me that a litigant can go on a fishing expedition and that there’s nothing wrong to it. Your thoughts.

my humble answer is no. in applying for the subpoena duces tecum the applicant must convince the court that he is in good faith and that no right of the accused will be violated. the documents to be brought to the court must be specified, otherwise it will be a general warrant and will cover everything. remember that in the search for justice it is not allowed no less than by the constitution that rights will be violated. how can we uphold the rule of law if we ourselves are trampling upon the rights of others who are equally protected by the law?
Subpoena is a legal summon requested by lawyers of either plaintiff or defendant to protect interest of their client. Subpoena could contain specific request on documents needed to be brought as long as they are related to the case. There are limits on documents when they contain privacy information of other people not related to the case so those information could be redacted or the needed information could be seen by judge alone and decides what are private unrelated to the case.The person being subpoenaed could be coming to court or in a deposition. Deposition is pre trial not necessary done in court. Trial is always in court.
When the accused or relatives or accomplices of accused are subpoenaed they could claim self incrimination right when asked in court so they dont have to answer the questions by the lawyer. Self incrimination riight or 5th amendment right in US means the person could not be forced to testify on something that could link him to be charged on the case.
Regarding documents that are protected by law the entity or person subpoenaed could protest the subpoena by filing TRO the way Corona and PSB asked SC ondollar accounts. If TRO was denied, PSB would be forced to release accounts.
Sheriff are used to deliver subpoenas but they can’t force the witness to testify. They are also used by court to arrest the witness if witness fails to show up in court that is if the witness is charged contempt of court.
Regarding garnishment of bank accounts.. That happens only if there is a monetary judgment on a case and if the losing defendant did not file an appeal and faied to pay the judgment the winning paintiff could file a writ of execution to the ank account of defendant. Again, the sheriff delivers only the writ to the bank but coud not force the bank to give the money to the sheriff then The bank freezes the account of the defendant.
Example the judgement is 5000 and the account contains 6000 the bank freeze 5000 plus its cost in doing the paperworks. This is the law on garnishment. When the frozen account was delivered to the winning plaintiff the bank account of defendant is unfrozen.
In some cases the plaintiff may petition the court to ask a sheriff to collect the personal properties of defendant like appliances, jewelries to pay for judgment but that is approved by court in writ of execution filing.

Let us pause for a while about the issues regarding CJ Corona. Kung totoo po ang article na ito, mas malaking halaga ito kaysa sa mga hindi dneclare ni (kung mapatunayan ng prosekusyon) ni CJ sa kaniyang SALN at ITR. At kung truthful declaration of SALN lang po at ITR ang pag-uusapan, tingin ko po ay impeachable ang halos karamihan ng government officials. Sa paglabas lang po ng isang ITR (CJ), nakita na natin na hindi na-o-audit regularly ito ng BIR kung hindi pa po naimpeach si CJ Corona.

Hi – I have read your blogs on the Binay recommendations. I have read so many times the recommendations and frankly I do not understand why there is so much hoopla about this. First, the recommendation said that Marcos is going to be buried in Ilocos – NOT AT THE LIBINGAN. So what is the fuss? The last time I checked, the hollowed grounds of the Libingan is in Taguig and hundreds of kilometers away from Ilocos. Second, the military honors is to be accorded as someone who have served the military. Again, what is wrong with that? Marcos was a soldeir, wasn’t he? Ms Raissa. May I suggest or recommend to Plaza Miranda contributors (perhaps a must for you, C. De Quiros, Malacanang’s Communications staff and RAFFLER Sr Staff), if you and they have the time and have not read yet the two authors: Malcolm Gladwell and Barbara Oakley.
There’s something about President Noynoy Aquino in Gladwell’s three books about his character that points to his potential to be Asia’s greatest statesman, probably greater than Singapore’s Lee Kuan Yew. What we see now in P Noy’s thoughts and actions is an utter LACK of MACHIAVELLIANISM which clinical psychologists had parallel studies as psychopathy.
Why P Noy cannot be like our past corrupt Presidents, Senators, Congressmen, Justices and high bureaucrats may be, but very likely will be explained by Dr. B. Oakley PhD. It is not possible to find President Noynoy in Dr. Oakley’s book which is about his opposites. The book is preponderantly about the enemies of the people as a whole or as individual citizens.
It is a face off between two scientific writers: Gladwell chronicles reasons behind successful good men while Oakley uses her scalpel to dissect the innards (este the genes) of successful evil men. Men and women that had or nowadays are still applying their craft to society. IF INTERESTED, just Google the authors’ names and the book titles will appear.

Ang dami ko natututunan sa pagbabasa ng mga blogs mo, even the previous ones. Sa isa sa nauna kong comment, I made a suggestion if you can come up with infographics for the appreciation of the youth who have short attention spans. (There was also a suggestion from among the CPMers to post or utilize the net cafes near or around the schools.)
I am suggesting infographics in a special page, because the youth and those who have shorter attention span can benefit from these information and get a wider dissemination of information. Just my suggestion, cheers.

The intro paragraphs say “China faces difficulty in alleviating tensions in the South China Sea because of contrasting mandates and a lack of co-ordination among its own government agencies, according to a study conducted by an international non-governmental group that strives to prevent conflicts.

But the format presents a problem for readers, like me, who want to read the most recent blogs to your articles. For example, important comments are still being posted on the Roseville property. I do not see a convenient way of reading the latest comments without scrolling past old comments.
I suggest that you put an option of sorting according to date only, and links on the body of the blog to its relevant blogs (e.g., links on blog 180.5.3 to 180.5, 180.5.2, and 180.5.4 if it exists).

Thank you so much of all your write ups! It gives me more insights on every issues that confronts our country, specially the current impeachment of CJ Corona.
I’ll just want to share my observation regarding the issues on when to reflect a real property on the SALN and if possible this observations should be brought to the attention of the Prosecution Team for their rebuttal time. As noted in the current proceedings, the Defense Team of Corona reason out that the Column Property of 3.5 M was only reflected in the 2010 SALN since the actual delivery took place only in August of 2009, though the full payment was made in 2004 with the issuance of the Deed of Absolute Sale and the Certificate of Title.
Per generally accepted accounting principles or the latest international accounting standards, this should have been reflected in the 2003 and 2004 SALN of Corona since he already have a cash out of an ASSET called CASH during these years. However, the Defense Team insisted that this should only be recognized once there was an actual delivery to the buyer. This seems to me as only PALUSOT by the Defense.
Please try to REVIEW the SALN of Corona from 2002 to 2005, in 2002 there was no entry on his assets of a CONDO unit purchased in installments in 1997, however at the starts of 2003 this was already reflected on his SALN….please take a look on the footnote that says “TITLE TRANSFERRED ONLY UPON FULL PAYMENT IN 2003″. This footnote was repeatedly reflected in the SALN from 2004 and 2005. Meaning, Corona knows from the starts that the basis for the recognition of the ownership of a property is once you have fully paid the said property since this is the time that Deed of Absolute SAle will be executed, then the issuance Certificate of Title will follow.
Please review also the entries of the figure for ASSESED and FAIR MARKET VALUES for the other Properties from 2003 up to 2010, they were all they same…please take note that the Defense insisted that Corona’s basis for the figure were taken from the ASSESORS records or TAX Declarations. As presented in the Court by various witnesses yong mga ASSESORS, they said this values will change every 3 years as passed by their respective city councils thru an ordinance…
In 2002 SALN, there was an entry for MOTOR VEHICLES with an acquisition cost of P1.13M, however, this entry DISAPPEARED on his SALN in 2002-2010. Wala na ba syang motor vehicles during that period?
based on my observations, there was really an INTENT by Mr. Corona to hide his TRUE WEALTH by undervaluing his various properties.

Based on the interviews, it seemed to me – and many others in cyberspace – that his revelations/responses to questions posed to him elicited even more queries, instead of making things clearer.
(1) Corona admitted that he lost his “trust” in PS Bank, which supposedly accounts for him withdrawing his peso accounts on Dec. 12, 2011, the day the impeachment complaint became official.
Is his trust peso-denominated? The reason I ask this is because he did not withdraw his dollar account/s. Is there a special reason why one can claim distrust on the local currency accounts but still have faith in the dollar ones?
Also – correct me if I’m wrong – but didn’t the PS Bank President or Branch Manager testify during the trial that Corona re-deposited the money (pesos) into a single account, at the very same branch?
How does Corona define trust in a bank?

(2) Corona claims he is “not involved” in the family squabbles of his wife regarding their BGEI Corporation concerns.
Why did he then say that he took a loan from the company?
Why did he admit that the millions that were in his personal account/s were BGEI money?

Why did he not declare these in his SALN, either from his personal account or as his wife’s money, with both cases covered under law as a must to declare?

(3) He claimed in one interview that he is all that stands between the President and what the President supposedly wants. (“Ako lang ang pumipigil na makuha ni Pnoy ang gusto nya.”)
Yet when their TRO decision on allowing former President Arroyo to travel was questioned, he said that the Supreme Court is a collegial body and that he is just one vote.
So, which is it? Are you the “last man standing” when it comes to the Palace, “valiantly” fighting off the dragons, or are you but one in a sea of voices?

(4) When asked if he himself would testify at the trial, he said he is willing but it is “dependent” on his lawyers.
Does he work for his lawyers? Why should he seek their clearance? Why would their permission be even needed? Here he is, on two TV stations proclaiming this and that, but you won’t face your charges in court?

Old SEC records may show how his expertise was used by Marcos to steal a reported $2 to $10 billion from the country.

What started out as a weekend show of Marcos “loyalists” turned into a weekly politically rally, then into violent Sunday demos, that eventually culminated in an open rebellion on July 6, exactly the 14th Sunday from Easter on the seventh month of the year. On that day, Tolentino took his oath as Vice-President of the Philippines and, in the absence of Marcos, proclaimed himself “acting President” under the l973 Constitution. The moment of Tolentino’s “last hurrah” had finally come, testing the four-month old Aquino revolutionary government.
In a ceremony at the driveway of the luxurious Manila Hotel, covered by both local and foreign media, the former running-mate of Dictator Marcos, flanked and backdropped by former members of the discredited defunct Batasan, was sworn into office by former Supreme Court Justice Serafin Cuevas. After naming his new “cabinet members”, the 75-year old “acting President” promptly directed former Speaker Nicanor Yñiguez to convene the Batasan, whose first order of business was to pass a law that would call for national elections at the earliest opportunity.
Members of the “Tolentino cabinet” included Rafael Recto as Justice Minister, Manuel Collantes as Foreign Affairs Minister, Isidro Rodriguez as Local Governments Minister and Manuel Alba as Budget Minister. Tolentino also appointed Juan Ponce Enrile Jr., Defense Minister, for whom the position of Prime Minister was reserved in concurrent capacity. Without the benefit of appointment, former assemblyman Gerardo Espina of Manila served as Acting Information Minister. Except for Enrile, who was “in the suburbs attending to private business”, all members of the “Tolentino cabinet” were present.
Before the oath -taking, Tolentino lowered the boom on President Aquino, describing her government as “illegal”. He claimed that Marcos and he were the country’s legitimate leaders, having been proclaimed “winners” in the last presidential and vice-presidential election by the Batasan, Characterizing both Cory Aquino and “Doy” Laurel as power grabbers, Tolentino produced a letter from Marcos authorizing him to assume as “legitimate head of the country until such time that I return to the Philippines.”

This is in reaction to the rantings and ravings of Miriam Santiago at the impeachment trial. When she took a private prosecutor to task and engaged him in what she termed a “colloquy,” little did anyone realize she meant to do a soliloquy and expected everyone to keep their mouth shut. For the irrepressible senator loves talking to and listening to herself so much she probably thinks she is the only person she can have a sane and intelligent conversation with. Thus, when the prosecutor tried to butt in, he should have seen it coming: “How dare you argue with me!”
After some hiatus due to high blood pressure (thank God for little mercies), Santiago returned with more barbs and rhubarbs. She was snorting like a raging bull—and did anyone notice those dagger-stares? She berated the prosecutors (again!) for not knowing the persnickety technicalities of the law. She also took potshots at her own colleagues for issuing subpoenas indiscriminately. We submit that having been away from the courtroom for a very long time, she already forgot the usual praxis that subpoenas are issued perfunctorily ex parte to compel production of testimonial and/or documentary evidence germane to the allegations made in a pleading (so long as they are not “privileged”). Nobody is sent to jail for procuring subpoenas in aid of prosecuting or defending cases. The paramount interest is the search for the truth. It is up to the court to determine the weight (or lack of it) of the evidence produced thereby.
But Santiago was simply being true to form: At times funny when in a good mood, but totally homicidal when provoked—which happens more often. Her colossal inability to manage her anger should be real cause for alarm. Lucky for us she won a seat as a judge in the International Criminal Court. Imagine what she would have said had she lost: “Who wants to be in the company of idiots anyway!” That’s what she said of our very own Supreme Court when the ship sailed without her in search of a new chief justice!
While in the Netherlands, she will be the egregious representation of the best “criminal” mind our country has to offer the world. Let’s all cross our fingers and earnestly pray she will not make a bizarre spectacle of herself there as she does so hilariously here almost all the time! Really, “[i]t’s more fun in the Philippines”?

Accusation of Wynnto his partner Okada is that he bribed 2 Pagcor officials, Naguiat and Genuino for $110,000. Letussayeach one received $55,000 each of casino perks.
I dont know if anyone of you have personal experince on so called “whale comps” in gambling. I did on countless times. “whale” in gambling is the guy who gambles with tons of money. Complimentary food and lodging to them is NORMAL.
They are given the best suite in the casino hotel. the $6,000 per night suite at Wynn casino is NOT their top of the line suite. Their mostexpesive presidetial suites are the $25,000 and $15,000 types. The$6,000 is tertiary level meaning it has an adjacent room, sala, dining room, jacuzzi, personal valet and nice view of LAS VEGAS strip.
It is not unusual that the family is included in the complimentary perks given. Food iste more expensive perks because it includes all meals and room service. It could easily cost $10,000 a day for a family of 4-5 people by availing the best restaurant food like caviar, lobster, foie gras,; complimentary premium drinks like Crystal champane and Louie XIII Cognac plus cost of food for room service and fees on the use of the resorts facilities, WiFi, spas, swimming pool and night clubs. Yes, there is fee on using the pools.
Wynn has 2 casinos, Encore and Wynn. Encore the newest and more expensive.
For 3 nights stay, easily, the tab could be at least $50,000 for the entire family.
Someties, the moment the whale family arrives complimentary gifts like expensive bags or perfume to the wife or watch for the husband is given as arrival gifts. Same complimentary perks are also given to VIP guests like high ranking government officials of a countries with casinos like what Mike Arroyo received from MGM or their high ranking casino executives like Genuino and Naguiat. This is standard operating procedure for all highend casinos.
I’m not a big whale but still my wife and I got complimentary gifts on arrival, perfume or jewelries in the form of coupons that could be redeemed from any high end stores in the casino grounds. Not unusual one whale coud get more than $ 2 M total comps in a year by going to the casino frequently. That is probably how Mrs. Naguiat got her Chanel bag, standard gift, and how Genuino and Naguiat got the perks unfortunately classified as bribe instead of casino business expense because they did not gamble. It’s not against US law because it is permitted business enticement to all gamblers and VIP guests.
The only motive Wynn against his partner is to derail Okada from owning his own casino in the Philippines in which their partnership is not involved and the best way to do it is destroy the credibilty of the 2 Pagcor officials which they accepted in good business faith, then the Philippine casino license would be jeopardized and Okada Nevada lcense would be revoked.
The only difference the Pagcor executives and Mike Arroyo were not whales. The reason Wynn classifed the perks as bribes rather than the standard “comps” since theydid not gamble commensurate to the comps given. In my assessment this is plain business squabble between partners. Wynn had a history of such greed when he owned his first casino, the Mirage,in which he also had some conflicts with his partners.
Same story, the rich partner bankrolled Wynn and when the business succeeded he started to squeeze out the partners.
What Genuino and Naguiat received were standard comps in casino for VIP guests.
This blog is dangerously uncritical and biased. Every article is a highway robbery and hit job on the defense side.
Specially the last blog on Cuevas issuing watch list orders. Thats not even the point. To attack him for doing his job provided in the constitution to provide equal protection is just, I dont know, you think of what word best describes that article.

This statement changes the whole article from being informative to being ill informed and dangerously unbiased and uncritical.
Cuevas and the defense if you bothered to understand it, had no problems with the watchlist order. They were interested, along with JPE with the non-compliance and the reason behind it not the issuance of the watchlist.

Maybe you should practice investigative journalism in making your articles. You are overly simplistic, uncritical and biased in ALL of them which is a shame to investigative journalists everywhere.

There were parallel occurences between the two events is all that was pointed out. The Section may also be used by whistle blowers. For example, a PS Bank employee disgusted with Corona’s dollar accounts might do an expose (after a Watergate-like investigation by you, where you promise not to reveal “Deep Throat”). Or someone in the Supreme Court might have detailed knowledge on how corporate taipans get an audience with Justices.
I will try to find a way to do this.

These days, I have been keen on reading the news and your blog as well. Maybe this one could help, although we are not sure if the person posting the comment on the abs-cbn site is one with integrity, i guess there is nothing wrong if we try to dig further.

There are really well meaning Pinoys who want to help including putting up funds.
I agree that we should embrace the ideas put forth but we also need to get our arms around it so that there is some control and set boundaries at di pupunta kung saan-saan direction tayo.
I suggest another thread on whats and hows, e.g. what the objectives are? limit only on corruption? which branches of government to focus on. Baka naman others like PCIJ are working along similar lines. What do we need to be efficient and effective- feet on the street to do the walking for you and enhance blogsite for security and responsiveness? I don’t know but more heads may point us in the right direction. What sieve must be in place to ensure information getting in are not hoax or just to derail and waste time/effort running after the leads.
Maybe you can PM your reliables like Johnny Lin, Mel, et al. Or you can interview TAPATT if they have similar grassroots initatives web based.

I was wondering if you can ask some lawyer who can explain the intricacies of a subpoena.
As explained to me by a law student friend, a sheriff, during execution proceedings, can require a bank to divulge whether a person has an account with it although he has no previous knowledge of its existence. If a sheriff can do this, why can’t an impeachment court in a trial of this magnitude?
Can banks be summoned to divulge whether Corona accounts exist without banks giving details?
So the prosecution allegedly got a fake bank documents in the course of its own investigation; did it make the Corona accounts less real?
I hope, ma’am, that you can research on this and enlighten us.

my humble and unsolicited answer. this is because the prohibition against examination of the bank account does not preclude its being garnished for satisfaction of judgment. The disclosure will be purely incidental to the execution process and it was not the intention of the legislature to place bank deposits beyond the reach of judgment creditor. See PCIB v. CA, GR no. 84526, January 28, 1991 the sheriff will use a writ of garnishment issued by the court and not a mere subpoena.

Can the prosecution resort to discovery rules to compel banks to divulge whether or not Corona has bank accounts? A friend told me that a litigant can go on a fishing expedition and that there’s nothing wrong to it. Your thoughts.
I’m just frustrated with the Defenses’s ploy to stop the examination. And Sen.-Judge Santiago’s repeated grandstanding on the bank documents issue.

my humble answer is no. in applying for the subpoena duces tecum the applicant must convince the court that he is in good faith and that no right of the accused will be violated. the documents to be brought to the court must be specified, otherwise it will be a general warrant and will cover everything. remember that in the search for justice it is not allowed no less than by the constitution that rights will be violated. how can we uphold the rule of law if we ourselves are trampling upon the rights of others who are equally protected by the law?

Subpoena is a legal summon requested by lawyers of either plaintiff or defendant to protect interest of their client. Subpoena could contain specific request on documents needed to be brought as long as they are related to the case. There are limits on documents when they contain privacy information of other people not related to the case so those information could be redacted or the needed information could be seen by judge alone and decides what are private unrelated to the case.The person being subpoenaed could be coming to court or in a deposition. Deposition is pre trial not necessary done in court. Trial is always in court.
When the accused or relatives or accomplices of accused are subpoenaed they could claim self incrimination right when asked in court so they dont have to answer the questions by the lawyer. Self incrimination riight or 5th amendment right in US means the person could not be forced to testify on something that could link him to be charged on the case.
Regarding documents that are protected by law the entity or person subpoenaed could protest the subpoena by filing TRO the way Corona and PSB asked SC ondollar accounts. If TRO was denied, PSB would be forced to release accounts.
Sheriff are used to deliver subpoenas but they can’t force the witness to testify. They are also used by court to arrest the witness if witness fails to show up in court that is if the witness is charged contempt of court.
Regarding garnishment of bank accounts.. That happens only if there is a monetary judgment on a case and if the losing defendant did not file an appeal and faied to pay the judgment the winning paintiff could file a writ of execution to the ank account of defendant. Again, the sheriff delivers only the writ to the bank but coud not force the bank to give the money to the sheriff then The bank freezes the account of the defendant.
Example the judgement is 5000 and the account contains 6000 the bank freeze 5000 plus its cost in doing the paperworks. This is the law on garnishment. When the frozen account was delivered to the winning plaintiff the bank account of defendant is unfrozen.
In some cases the plaintiff may petition the court to ask a sheriff to collect the personal properties of defendant like appliances, jewelries to pay for judgment but that is approved by court in writ of execution filing.

Let us pause for a while about the issues regarding CJ Corona. Kung totoo po ang article na ito, mas malaking halaga ito kaysa sa mga hindi dneclare ni (kung mapatunayan ng prosekusyon) ni CJ sa kaniyang SALN at ITR. At kung truthful declaration of SALN lang po at ITR ang pag-uusapan, tingin ko po ay impeachable ang halos karamihan ng government officials. Sa paglabas lang po ng isang ITR (CJ), nakita na natin na hindi na-o-audit regularly ito ng BIR kung hindi pa po naimpeach si CJ Corona.

i am an OFW and i have deeply suffered humiliation and economic loss in the hands of the airport immigration and the stupid policy of POEA and the DFA. Can you please disguise yourself as an OFW and experience for yourself the treatment that OFWs from the hands of POEA and Immigration? I have been offloaded twice in 2009 and 2011. I am now in self exile as I have suffered nightmares that I will never be allowed to leave the Philippines again once I get back. For a person who has a hammer, all things look like nails. For person in power, especially the POEA and the Immigration, all Pinoys look like OFWs and has to through POEA even if you are just a tourist. Next time I will be offloaded the plane, I plan to do self immolation just like what the monks did during the Vietnam War to protest the government’s lack of attention to the suffering and humiliation of the OFWs from th hands of POEA and Immigration. Can you give me your number so that my ultimate sacrifice can be covered by the media. Actually, I plan to cover my body with aluminum foil just to be sure that I will survive and read the accounts of my ultimate sacrifice in your blog. Hi – I have read your blogs on the Binay recommendations. I have read so many times the recommendations and frankly I do not understand why there is so much hoopla about this. First, the recommendation said that Marcos is going to be buried in Ilocos – NOT AT THE LIBINGAN. So what is the fuss? The last time I checked, the hollowed grounds of the Libingan is in Taguig and hundreds of kilometers away from Ilocos. Second, the military honors is to be accorded as someone who have served the military. Again, what is wrong with that? Marcos was a soldeir, wasn’t he? I would really like to know your thoughts on this.
Do you think Edsa 1986 was just a “partisan conflict”?
Do you think what Marcos did when he was the President does not negate what he did during the war?
Do you think he’s a hero who should be honored?
Hold on – the discussion is about whether or not the Binay recommendation is too much for a despot like Marcos (there you go I called him a despot – so I am not at all a fan of Marcos). Nor am I a fan of Binay either. Binay recommended that Marcos is buried in Ilocos and with military honors befitting a former soldier. Where did it say in the recommendation that Marcos be accorded a hero’s burial? What do you mean what he has done negates his being a soldier? Magdalene was a “paid woman”. Did this negate her becoming a ‘saint”?
